Owner And Employee Of Medical Supply Distributor Charged With Medical Device And Over-The- Counter Drug Fraud Scheme
Moses Rabinowitz and Menachim Samber, owner and employee of medical supply distributor Trasco, LLC, were charged with a wire fraud and conspiracy scheme to obtain medical devices and over-the-counter drugs not approved for sale in the US, resulting in losses of over $5 million.
Moses Rabinowitz and Menachim Samber were accused of conspiring to defraud medical device and over-the-counter drug manufacturers out of more than $5 million. The alleged scheme, which ran from 2014 to 2019, involved using fraudulent documentation and 'dummy' export shipments to deceive manufacturers into selling FDA-regulated products at deep discounts. Rabinowitz and Samber were charged with one count each of wire fraud conspiracy and conspiracy to obtain pre-retail medical products by fraud or deception.
Moses Rabinowitz, owner of medical supply distributor Trasco, LLC, and employee Menachim Samber were charged with conspiring to defraud medical device and over-the-counter drug manufacturers out of more than $5 million. The alleged scheme, which ran from 2014 to 2019, involved using fraudulent documentation and 'dummy' export shipments to deceive manufacturers into selling FDA-regulated products at deep discounts. Rabinowitz and Samber would then remove foreign labeling to conceal the products' origins from U.S. consumers and distributors, and sell the products domestically at a substantial profit. The scheme was uncovered through a joint investigation by the FDA's Office of Criminal Investigations and the U.S. Postal Inspection Service. Rabinowitz and Samber were indicted on one count each of wire fraud conspiracy, which carries a maximum sentence of 20 years in prison, and conspiracy to obtain pre-retail medical products by fraud or deception, which carries a maximum sentence of 15 years in prison. Both defendants were arrested and are presumed innocent until proven guilty.
